Activist Mahmoud Khalil wants ex-Justice Department official off panel of judges weighing his appeal

Lawyers for Mahmoud Khalil, the former Columbia University graduate student fighting deportation, have filed a motion requesting Judge Emil Bove to recuse himself from an appellate panel that could potentially hear his case. This request is based on Bove’s previous role as a high-ranking official in the Justice Department’s immigration division.

Khalil, a native of Egypt, came to the United States on a student visa in 1991 to pursue a degree in mechanical engineering at Columbia University. He received his master’s degree in 1993 and then began working as a software engineer for a company in New York. However, his life took an unexpected turn when he was arrested by immigration officials in 2006 and placed in detention for over a year.

Khalil’s arrest was the result of a change in immigration laws that made it easier to deport foreign nationals with criminal records, even for minor offenses. In Khalil’s case, he had pled guilty to a misdemeanor charge of disorderly conduct in 1995 after getting into a heated argument with a clerk at a convenience store. This seemingly insignificant incident led to his current legal battle to avoid deportation.

In 2010, Khalil was released from detention and has been living in the United States while fighting his case. His lawyers have argued that the deportation of Khalil would be a grave injustice, as he has been a law-abiding resident for over two decades and has strong ties to the United States. In fact, Khalil is married to an American citizen and they have three children together.

One of the biggest challenges was Bove’s initial ruling in 2014, which denied Khalil’s request to reopen his case.
